These terms govern your use of the Maybee app and the site maybee.app. Please read them once in full. They are written in plain language on purpose, because you should know what you are agreeing to.
Your contract is with Pik Production GmbH, Georgsstrasse 38, 30159 Hannover, Germany, registered at the district court of Hannover under HRB 227341, represented by its managing director Jan Pulfer. Referred to below as we or the provider.
This agreement is between you and us only, and not with Apple. Apple is not a party to this agreement. We alone are responsible for the app and its content. These terms apply accordingly if you obtain the app through another distribution channel; the operator of that channel then takes the place of Apple.
Maybee is a decision aid for everyday life. You ask a question, Maybee gives a short recommendation with a confidence figure and one sentence of reasoning. Later the app asks how it went and learns from your ratings.
Maybee is not advice. Its recommendations are a nudge, not information you can rely on. In particular, Maybee is
The recommendations do not take your personal situation into account and can be wrong. If a decision concerns your health, your rights or a significant amount of money, ask a qualified professional. Responsibility for every decision you make stays with you.
In an emergency, Maybee is the wrong place. If there is an immediate danger to life, call the emergency number, 112 in the European Union. In an emotional crisis you can reach free help around the clock on 116 123 across most of Europe, and in Germany also on 0800 111 0 111 and 0800 111 0 222.
You must be at least 16 years old. If you are younger, you may only use the app with the consent of a parent or guardian; the AI features stay switched off until that consent is given.
You need a suitable device and a current operating system. The AI answers and Hive also require an internet connection. Without a connection the app still decides, but then only with the logic that runs on your device. You bear the cost of your own internet connection.
We grant you a non-exclusive, non-transferable licence to use the app on devices that you own or control, for your personal, non-commercial purposes. On Apple devices this licence is subject to the Usage Rules set out in the Apple Media Services Terms and Conditions, including through Family Sharing.
All rights not expressly granted to you remain with us. In particular you may not rent, lease, lend, sell, redistribute or sublicense the app.
Maybee can pass your question to an AI model so the answer fits what you actually asked. This is voluntary. We ask for your explicit consent before the first question leaves your device.
AI output can be factually wrong, incomplete or inappropriate. It is not the result of human review. Check anything you intend to act on. Do not enter details in a question that you do not want to share, in particular no health data, no credentials and no personal data about other people.

The app detects from certain words that a question touches a sensitive area, and then treats it differently:

This detection works from word lists and is inherently incomplete. It can miss questions and it can misclassify harmless ones. Do not rely on the app to catch a dangerous question in every case.
Confirming the notice does not change section 2. If you choose to receive a recommendation in a sensitive area, you still do not receive advice, but a nudge from something that does not know your situation. By confirming, you acknowledge this.
With Hive you can put a decision to a vote and share a link. Anyone who has the link can vote in a browser without installing the app.
You are responsible for the content you publish this way. Do not submit questions that infringe the rights of others, contain personal data about third parties, or are abusive, discriminatory or unlawful. The link is not protected: anyone who knows it can see the question and the options. Only share it with people you would ask the question directly.
If you put a photo comparison to a vote, both pictures are uploaded to our server so that your friends can see them. Anyone with the link can see them. Do not submit pictures showing other people without their consent, and none you do not hold the rights to. Details are in the privacy policy.
We may remove votes that breach these rules. Votes and their pictures are deleted automatically after 30 days.
The core features are free. For free you can make ten decisions per month. Maybee+ removes that limit and adds further features.
Prices may change. A change applies from the next renewal period only, and we announce it in advance.
As a consumer you generally have a fourteen day right of withdrawal for contracts about digital content. Because purchases and subscriptions are handled through the App Store, withdrawal follows the Apple Media Services Terms and Conditions. Request refunds directly from Apple there.
If you exceptionally obtain a paid service directly from us, the following applies: the right of withdrawal expires early once we have begun performance after you expressly agreed that we may begin before the withdrawal period ends and confirmed that you thereby lose your right of withdrawal. An email to info@pikproduction.com is enough to withdraw.
We aim for reliable operation but do not owe any particular level of availability. Maintenance, faults and outages at service providers can cause interruptions.
We may develop, change or discontinue features. If a feature you paid for is removed, you may cancel your subscription at the next possible date. The decision feature keeps working on your device without our servers.
We alone are responsible for maintenance and support. Apple has no obligation whatsoever to furnish any maintenance or support services. You can reach us at info@pikproduction.com. We usually reply within five working days.
The statutory provisions on defects in digital products apply. We alone are responsible for any warranties, not Apple.
In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you, if one was paid. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app. We alone are responsible for any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulent concealment of a defect, to the extent of any guarantee we have given, and under the German Product Liability Act.
For slightly negligent breach of a material contractual obligation, meaning an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely, our liability is limited in amount to the foreseeable damage typical for this type of contract.
Otherwise our liability is excluded.
Expressly not covered by our liability are disadvantages arising because you followed a recommendation of the app. The recommendations are not advice, see section 2, and the decision is yours.
These provisions also apply to the personal liability of our legal representatives and agents.
We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app. These include in particular
In the event of any third party claim that the app infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of any such claim.
The app, its source code, its design, the name Maybee and the bee mark are protected by copyright and trade mark law and remain our property.
By using the app you represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a terrorist supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You also comply with all applicable export control rules.
You must comply with applicable third party terms of agreement when using the app. These include in particular the Apple Media Services Terms and Conditions and the terms of your mobile network operator.
Apple and Apple's subsidiaries are third party beneficiaries of these terms of use. Upon your acceptance of these terms, Apple will have the right, and is deemed to have accepted the right, to enforce these terms against you as a third party beneficiary.
How we handle your data is set out in the privacy policy. In short: your decisions stay on your device, there is no account, and without your consent no question goes to an AI.
Use of the free features is open ended. You can stop using the app at any time by deleting it. Your data is on your device and is removed with it; you can also delete it separately in the settings.
We may terminate this agreement without notice for good cause, in particular for serious breaches of section 7 or 10. In that case we refund paid but unused periods on a pro rata basis, unless the breach is your responsibility.
We may change these terms where there is an objective reason to do so, such as new features, a change in the law or a change in case law. We will inform you of changes at least 30 days in advance in the app or by email, if you have given us one.
If you do not object before the change takes effect, the changes are deemed accepted. We will point this out separately in the notice. If you object, the agreement ends when the change takes effect; you may cancel a running subscription at that date.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you have your habitual residence in another member state of the European Union, the mandatory consumer protection provisions of that state remain unaffected by this choice of law.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Hannover.
The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
Should any provision of these terms be or become invalid, the validity of the remaining provisions is unaffected. Amendments and additions require text form.
The German version of these terms prevails. Translations are provided for convenience.
